A. Session Fees
Client agrees to pay photographer a 50% deposit at the time of booking to secure their appointment date and time. This is a non-refundable retainer fee that goes toward your session. The remaining balance is due at the start of the session. Your session fee covers the time and talent of photographer and creative editing of images, as determined by the photographer, and images to be downloaded by client via dropbox.com. Please be sure to review all pricing details. Pricing information can be found on the "Pricing" page at www.alissabethphoto.com. There are no refunds or exchanges of any kind due to the custom nature of portrait photography.
B. Rescheduling
If an illness or situation prevents a photo session from taking place, client may reschedule their session at least 24 hours prior to their shoot without penalty. Should client fail to give 24 hours notice, or decide to completely cancel the shoot, this session fee is forfeited and will not be refunded. Photographer reserves the right to reschedule due to illness, weather, equipment malfunction, or other circumstances beyond her control.
C. Re-shoots / Refunds
Re-shoots are determined at the discretion of the photographer. There are no refunds.
D. Archive
After six (6) months, all images will be purged from photographer’s hard-drive, except as needed for promotional purposes, to be determined by photographer at photographer’s sole discretion. Photographer is not responsible for loss or damage to the digital files due to circumstances beyond photographer’s control.
E. Payment
All payments are due in full unless payment arrangements have been made. Orders will not be processed until payment in full is received. If client has arranged a payment plan, order will be placed after the final payment has been received.
F. Damage
Photographer is not responsible for the damage of portraits after delivery to client, including damage caused during transit by US mail. Client assumes all responsibility for the safety of all portraits upon receipt.
G. Your Session
Please be prompt for your session. I schedule around best lighting times for all outdoor shoots. Arriving late to your appointment will result in lost session time. If you are running late, please let me know. Your session may need to be rescheduled if you arrive over 20 minutes after our scheduled start time. If you fail to show for your scheduled appointment or your session has to be rescheduled due to tardiness, an additional $50 deposit will be required to reschedule.
If you have not already, please review samples of my work to make sure that my style of photography and editing is a good fit for you (these can be seen on my website at www.alissabethphoto.com or facebook.com/alissabethphoto).
When you book with me, you are giving me full reign over session styling and artistic editing of photos. I will be choosing the best of the images to edit and present to you so if you see anything that you don’t care for during the session, PLEASE speak up. It won’t hurt my feelings as I want to make sure I’m providing you with pictures that you will love. My standard editing workflow includes brightening, cropping, and standard darkroom sharpening and contrast to create a high quality, beautifully edited photograph. Master editing includes cleaning up skin blemishes and skin tones such as acne and fine lines. It is not my intention to change the way you look but to bring out the very best you within the portrait.
H. After the session
You will receive an email to view and download your images online within two weeks. If you would prefer to receive your digital images on a CD or flash-drive, please let me know and I would be happy to accommodate. Please note, again, there no refunds or exchanges on fees paid due to the custom nature of portrait photography.
I. Sales Tax
All fees and products are taxable for the state of New York. Prices shown do not include the 8.75% NY sales tax.
J. Model Release
I hereby give to Alissa Beth Photography photographer Alissa Rosenberg the absolute and irrevocable right and permission with respect to the photographs that she has taken of myself and/or my minor child in which she may be included with others:
a) To copyright the same in the photographer’s name or any other name that she may select;
b) To use, re-use, publish and re-publish the same in whole or in part, separately or in conjunction with other photographs, in any medium now or hereafter known, and for any purpose whatsoever, including (but not by way of limitation) illustration, promotion, advertising and trade, display, website, portfolio, competitions, vendor publication or publication to promote the studio and;
I hereby release and discharge photographer from all and any claims and demands ensuing from or in connection with the use of the photographs, including any and all claims for libel and invasion of privacy.
K. Liability
Photographer is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business. The Client(s) will waive, disclaim and release Alissa Beth Photography (ABP) and its respective owners, members, employees, agents, volunteers and representatives from any and all actions, claims or demands that they may have now or in the future, whether known or unknown, against the ABP Parties, including without limitation those related to injury to or death of persons, or damage, loss or destruction of property arising out of or in connection with the Session or any products related thereto.
L. Indemnification
The client hereby agrees to indemnify and hold harmless the ABP Parties from all liabilities, losses, claims, costs (including attorney’s fees and court costs), damages or expenses of whatever nature that may result from injury to or death of persons, or damage, loss or destruction of property arising out of or in connection with the Session or any products related thereto.
M. Copyright & Penalty
Alissa Beth Photography retains all copyrights to all images created during a client’s session. A print release will be provided with digital files to print portraits for personal use and sharing. The print release does not allow publication of your portraits (i.e. entering in contests), selling or altering of your images without the photographer’s written permission.
N. Sneak Peaks and Facebook Sharing
Alissa Beth Photography will post a sneak peek of a favorite shot(s) from the session on the Facebook page and encourages the client(s) to tag himself/herself and share with friends and family. Please note that clients are allowed to use these on their Facebook Profile as long as the watermark remains fully intact, and the photo is not altered in any way
O. Refund Policy
The Client(s) hereby agrees that he/she fully understands that there are no refunds or exchanges on purchases due to the custom nature of portrait photography unless the photographer deems that the photos are not sale worthy or if the digital images were lost or damaged before processing of the photos occurred. If any of those rare cases occurs then the client will receive a full refund of all monies paid.
Other Info
All images taken at your session are edited at the photographer’s discretion. They are a representation of the best photographs from your session. Any images that did not "turn out" i.e. blurry, blinking, lighting was off, will not be included in your proofing download or full resolution download. Images are taken in color format and edited to adjust color, contrast, saturation and sharpness to ensure the best quality.
Alissa Beth Photography reserves the right to use any photograph in any form such as, but not limited to, the use in advertising, reproduction, and copyright. All images are copyrighted by Alissa Beth Photography, even those you purchase. Copying, scanning or reproducing images is strictly prohibited. Print-screening images from this website is also against the law. All offenders will be prosecuted accordingly. Prices are subject to change without notice and are non-negotiable. Due to the custom nature of photographic products, no refunds will be issued. By Alissa Beth Photography, you agree to these terms.
